Frequently Asked Impounded Vehicles Questions
Q: Does it matter how long I leave my vehicle at 5-Star Towing and Recovery by Greenland Auto Salvage, Inc.?
Yes. Fees are assessed daily, to minimize your costs, pick-up your vehicle as soon as possible. Furthermore, after a set period of time (approximately 45 after a notice of intent is received), it becomes at risk of being sold at lien sale (contact our office for the specific timeline for your vehicle).
Q: What happens if I don't retrieve my vehicle in time?
If you are unable to pick up your vehicle within the set time before the lien sale ends, you have two options:
You can do nothing and leave your vehicle. We will attempt to sell it and recover the towing, storage, and administration fees. If the vehicle does not sell, or the sale price does not cover the fees, we will begin collection proceedings to recover the remaining balance.
You cannot dump your vehicle per Arkansas law:
— Removal of Unattended or Abandoned Vehicles
(a) (1) The owner of a vehicle and the person who left the vehicle unattended or abandoned or any owner or operator waiving an owner's preference shall be liable for all reasonable costs of towing, recovery, storage, and other incidental costs related to such a removal.
(2) If the vehicle is sold by foreclosure under § 27-50-1209, the owner or operator shall be liable for such costs in excess of the proceeds of the sale of the vehicle.
Option 2 We understand that sometimes people are in a difficult situation and may not have the means to be able to claim their vehicle. In this situation, we offer an 'amnesty' for the vehicle. This works by you paying us for the tow charge, ten days of storage and the lien fees. (This covers our costs). Then we keep the vehicle and do not proceed with the collection process. For anyone interested in protecting their credit, we strongly suggest this option.
Note: If you choose not to participate in the 'amnesty' program, during the lien sale, we cannot not offer you "amnesty" after the lien sale. Once the vehicle account is with the collections agency, we do not have the right to negotiate the vehicle. If you have any questions, please do not hesitate to call our office, we are happy to answer any questions you may have.
Q: What if I'm not the vehicle's registered owner? If you are not the registered owner, you must have the registered owner come into our office with you, or provide proof of ownership. If the registered owner is not able to be present you must have a notarized Letter of Permission for Release.
